CURRENT DEVELOPMENTS 2022

 

A steady increase in regulatory requirements can also be observed in the field of construction product labeling. For screws for use in wooden structures, several new versions of the relevant standards (EN 14592 and EAD 130118) have appeared in recent years, bringing with them a great deal of uncertainty about the requirements currently in force. At the same time, the activity of national regulatory authorities is increasing, and complaints and possible penalties are also becoming more frequent. The BREXIT and the new UKCA marking, which will finally replace the CE marking for the UK market from 1.1.2023, pose even greater challenges for the manufacturers concerned.

 

We at AVVIO are therefore observing a particular need for information in the process of ETA creation. Many parties involved are not aware in detail of the various options for obtaining an ETA and the associated benefits and risks. One example is so-called "reproduction ETAs." In this case, the future ETA holder does not go the usual, costly and time-consuming route of creating a completely new ETA, but enters into an agreement with the holder of an existing ETA to create a copy of that ETA. The exact content of such an agreement is of course of particular importance in order to avoid risks for both parties.

 

Another example is the obligations of the ETA holder and other market participants such as importers or distributors. For example, the question of how to correctly label a construction product, i.e., what information is mandatory to include on a label and who is responsible for it, is a constant source of uncertainty, partly because the relevant standards leave much room for interpretation.

For example, errors in the labeling of construction products can also lead to major consequential expenses and thus also financial damage if, for example, goods are temporarily blocked by authorities and they first have to be relabeled before being sold.
